Maldon District Concil is working in partnership with Essex Shared Services to spport the recritment of the role of a S16 and Monitoring Officer, a fll-time position offering hybrid working with a minimm of days in the office per week. Office attendance will be in line with the needs of the Concil and the Planning Policy Team, inclding occasional evening committees or meetings where necessary. The role is within the Concil's Planning Policy team, which is part of the Place, Planning & Growth directorate. This is an exciting time to join the Planning Policy Team at Maldon District Concil. The Concil has recently agreed proposals to commence preparation of the new Local Plan. We are the first local athority in Essex to be prodcing a Local Plan nder the new 3-month plan-making system, which will set ot a long-term vision for Maldon District, inclding where homes, jobs and infrastrctre shold be located, how high-qality design will be spported and how the district's distinctive natral and historic environment will be protected and enhanced.

We are also involved in a wide range of ongoing planning policy work otside of the new Local Plan, inclding spporting Parish Concils with neighborhood plans, managing S16 agreements, ndertaking monitoring activities and prodcing the Athority Monitoring Report (AMR). Alongside this, we are also working closely with or Development Management colleages on a nmber of significant development proposals crrently being broght forward by developers.

As the Concil's S16 and Monitoring Officer, yo will spport the Planning Policy Team to focs on delivery of the Local Plan by leading on the following key accontabilities:
  • Maintain and manage accrate records of Section 16 agreements, nilateral ndertakings and associated planning obligations, inclding financial contribtions, affordable hosing, open space, highways, edcation, health, biodiversity, environmental mitigation and other infrastrctre reqirements.
  • Monitor the implementation of Section 16 obligations, inclding triggers, commencement dates, payment points, indexation, spend deadlines and delivery of non-financial obligations.
  • Liaise with key stakeholders across a wide range of internal and external partners and colleages to ensre obligations are properly secred and delivered.
  • Spport the negotiation and drafting of Section 16 agreements by providing monitoring information, infrastrctre evidence, contribtion reqirements and delivery pdates as reqired.
  • Isse invoices, monitor payments, reconcile receipts ensring contribtions are correctly allocated for the prposes set ot in the relevant legal agreement.
  • Track the spending of Section 16 contribtions, ensring fnds are sed lawflly, effectively and within any relevant deadlines or restrictions.
  • Prepare monitoring information and reports for officers, senior managers, Members and external stakeholders, inclding information reqired for the Concil's Infrastrctre Fnding Statement and other stattory or corporate reporting.
  • Spport the preparation and maintenance of infrastrctre delivery information, inclding evidence to inform the Local Plan, infrastrctre planning and developer contribtion priorities.
  • Respond to qeries from applicants, agents, developers, infrastrctre providers, Members, parish and town concils and members of the pblic on Section 16 obligations and developer contribtions.
  • Maintain clear adit trails to ensre all records are accrate, transparent and capable of withstanding internal adit, external scrtiny and Freedom of Information reqests.
  • Assist with the review and improvement of internal and external processes for the management and monitoring of developer contribtions.
  • Spport enforcement and recovery action where planning obligations are not complied with, working with key stakeholders across a wide range of internal and external partners and colleages as appropriate.
  • Leading on the prodction of the hosing trajectory, Athority Monitoring Report and Infrastrctre Fnding Statement.
  • Lead on monitoring reqirements inclding keeping relevant data and information p to date.
  • To assist with the preparation and pblication of the Concil's Five-Year Hosing Land Spply Statements and associated monitoring reqirements.
  • To act as an expert witness for planning appeals and within the Local Plan examination on the matter of hosing land spply, with spport from the Planning Policy team.
  • Spport and, where appropriate, administer the Concil's CIL fnctions. This may inclde maintaining CIL records, calclating liability, issing stattory notices, monitoring commencement notices and instalments, processing reliefs and exemptions, spporting collection and enforcement, reconciling income, and preparing information for stattory CIL reporting and governance arrangements.
